COMMERCIAL/CONTRACT LAW MAXIMS





1. Thou shall not steal: a work man or woman is worthy of their higher.

2. Equity before the law: all are equal under the law, binding on everyone (Natural Law first, commercial law after).

3. In commerce, truth is sovereign: your word is your bond. If this wasn't the case, there would be no basis for anything and nothing would have any meaning. 

4. Truth is expressed in the form of an affidavit: solemn expression of truth, there can be no valid commercial transaction without someone taking liability for that claim. 

5. An unrebutted affidavit stands as truth in commerce: unchallenged claims remain as truth in the matter. Remaining silent is acquiescence.

6. An unrebutted affidavit becomes the judgement in commerce: according to silence there is nothing left to resolve.

7. In commerce, for any matter to be resolved it needs to be expressed: when there is controversy, both parties need to express their point of view. 

8. He who leaves the field of battle first looses by default: courts deal with disputes or controversies with statements of truth (affidavits).

9. Sacrifice is the measure of credibility: sacrifice here meaning 'measure of conviction', willingness to take liability. 

10. A lien or claim can be satisfied only through rebuttal by counter-affidavit point-for-point, resolution by jury, or payment: those are the only ways in which a claim can be satisfied. 

Commercial/Contract Law is non-judicial because it is timeless, it is pre-judicial. It is the foundation in which governments are build upon. 

No fictional entity can write an affidavit of truth and no court and no judge can disregard somebody's affidavit of truth.

ASSESSMENT PHASE - Who owes who, what, why, how and for what reasons.

A proper assessment needs a valid affidavit or a true bill in commerce which is a true accounting. A valid contract with the one in deffault's signature, a list of goods an services which the one in deffault owes. 

COLLECTION PHASE - Payment, resolution. For this second phase, it is essential to have undergone a proper assessment.
